Terms & Conditions

Off the Beaten Path, LLC Terms and Conditions.

Policies valid and effective for all tours booked on and after August 22, 2019.

TOUR DEPOSIT AND PAYMENTS:

CANCELLATION POLICY:

You may transfer from one trip to another before trip departure without any penalty (excludes custom designed-private tours), as long as space is available on the tour date requested. This is a one-time option available to travelers, and OTBP must be notified of intent to switch no later than 90 days before booked tour departure date.


Off the Beaten Path, LLC Terms & Conditions

PARTIES: Off the Beaten Path, LLC, hereinafter referred to as “Operator”, provides tours in the country of France (each a “Tour”). These Terms and Conditions apply to each Tour program provided by “Operator”, hereinafter referred to as “Tour”. In these Terms and Conditions, the undersigned is hereinafter referred to as “Guest”. It is each individual traveler’s responsibility to read and understand the Operator’s terms and conditions. Completion and submission of Operator’s online booking form accompanied by the per person tour deposit by Guest constitutes Guest acknowledgement, acceptance and agreement of Operator’s terms and condition. All monies are paid in US Dollars. Operator reserves the right to change its travel policies without notice.

RESERVATIONS are accepted by Operator upon receipt of a completed and electronically signed, online reservation form or upon receipt of a completed and signed, printed reservation form accompanied by a Tour deposit of US$500 per Guest per Tour. The remaining balance of the Tour is due no later than 90 days prior to the Tour departure date, and Operator will email Guest an Invoice for balance payment of Tour. Operator reserves the right to assess an administrative convenience fee on all balance payments not to exceed four percent of the balance due as designated by law. Reservations made within 90 days of Tour departure date are subject to full payment within seven days from the date of receipt of Tour reservation. If Operator does not receive balance payment of Tour from Guest by the designated due date, Operator reserves the right to cancel Guest reservation, if balance payment is not received accompanied by the late fee within seven days following the due date. If Operator cancels Guest reservation due to non-payment, Guest forfeits the deposit and is responsible for any additional late fees due. Operator reserves the right to assess a US$500 per person late fee on balance payments received after the final designated payment due date, and all applicable discounts are forfeited by Guest. Specialty event tours, private tours and custom designed tours require a non-refundable deposit of US$1,500 per person, and final tour payment for specialty event tours, private tours and custom designed tours is due no later than 120 days prior to the tour departure date. The late payment penalty for private tours and custom designed tours is $1,000 per person.

CLIENT CANCELLATION POLICY: Operator strictly adheres to its cancellation policy. Exceptions to Operator’s discount, promotion, promotion packages and/or cancellation policy cannot be made for any reason, including weather, terrorism, civil unrest, personal emergencies, change of heart or change of plans. If Guest chooses to cancel his or her reservation, Operator must receive written notice of said cancellation in writing and hand signed via certified mail (with confirmation of receipt from Operator). Standard Cancellation Policy: Guest shall be subject to the following cancellation fee schedule: There is no cancellation fee, if tour monies paid are put on hold towards a future trip. If Operator receives written notice 91+ days prior to the Tour start date, the Tour deposit is 100% refundable. If Operator receives written notice 31+ to 90 days prior to the Tour start date, Operator shall withhold a cancellation fee of US$500 per person. If Operator receives written notice 30 days or less prior to the Tour start date, Operator shall withhold a cancellation fee equal to US$1,000 per person. If Operator receives no written cancellation from Guest, and/or Guest does not show-up for the Tour, or Guests submits written cancellation on/after first day of tour, Guest shall incur a cancellation/no-show fee equal to 100% of Tour monies paid and is not eligible to put funds on hold for future tour. Cancellation date is the date such notice is received in writing by Operator and acknowledged as received by Operator.  Any refunds due to Guest are released on first day of cancelled tour. No exceptions to Operator’s cancellation policy can be made for any reason.

OPERATOR CANCELLATION OR SUBSTITUTION: Operator may cancel any Tour at any time before departure for any reason, including without limitation, if Operator deems the number of Guests signed up for a given Tour to be insufficient to operate such Tour. Operator may in its’ sole discretion substitute a service or good of similar quality for any service or good stated in a Tour itinerary without notice. Operator shall attempt to notify Guest of the cancellation of a Tour for which Guest has paid a deposit or Tour Fee as soon as possible after Operator’s final decision to cancel such Tour. If a Tour is cancelled, Operator’s liability is limited to a full refund of affected Guest’s Tour deposits and Tour Fees, and Operator will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever in such circumstances. Operator is not responsible for any loss incurred on account of non-refundable or non-transferable air tickets. Operator Itineraries are subject to change: France is full of surprises and flexibility is a key ingredient to enjoying any small group travel experience to the fullest. Due to circumstances beyond its control, Operator may make partial changes to the stated itinerary. Every effort is made to keep changes to a minimum, and its high quality is always maintained. If Guest encounters any problem during the delivery of a Tour, Guest is requested and responsible to bring the problem to the lead guide’s attention immediately in order to give the guide and Tour team the chance to correct the problem. Uncompleted or unused portions of any tour itinerary are not cause for complaint or refund. If for reasons beyond Operator’s control, a Tour in progress must be interrupted or cancelled, Operator will in good faith refund a portion of the Tour Fees depending on Operator’s actual costs incurred compared to the Tour as originally contemplated.

TRANSFER OF DEPOSIT: Guest may transfer from one trip to another up to 91 days before trip departure without penalty (excludes Travel Agent bookings and custom designed and private tours) after which time Operator’s cancellation policy applies. When transferring to a different date or trip, if the trip costs more than Guest’s original trip, Guest must pay the difference. This credit can only be rolled over once and Guest incurs no other penalty.

INCLUDED in the price of the Tour are the following: Professional Off the Beaten Path, LLC historian guide/Tour leader(s) who also serves as Guests’ liaison during the Tour, hotel accommodations as designated by Operator during the Tour, entry fees to historic sites and monuments detailed as included in the finalized tour itinerary price, fees for interactive excursions during the Tour as detailed in the finalized itinerary price, such as, cooking classes, winery tours and wine tasting, some beverages during meals provided on the Tour as detailed in the finalized tour itinerary and designated by the Operator–for wines included at group meals the allocation is a a maximum one half bottle per person per group meal and some meals the designation is a maximum of one third bottle per person, hotel taxes, breakfast daily, gratuities to service personnel at restaurants designated in the finalized itinerary and at the hotel, meals as specified in the finalized itinerary, private ground transportation during the tour from Tour start date pick-up time and Tour conclusion drop-off time at the designated times and locations. Wine provisions are included with Tour group meals, as designated by Operator in each itinerary, at a maximum allocation equal to either one third bottle per person per group meal or a half bottle per person per group meal. Guest is responsible for payment of all cocktails and wine ordered and consumed in excess of Operator’s allocation, as well as personally ordered cocktails and wines consumed in place of provisions provided during Operator’s Tour.

NOT INCLUDED in the cost of the Tour price are the following: Roundtrip airfare to and from France and roundtrip train fare to Tour start and conclusion city/group meeting location, telephone calls, personal items, laundry, individual purchases, pre-dinner alcoholic and non-alcoholic beverages, beverages and wines beyond provisions of the tour and/or in place of the Tour provisions, extra meals or snacks, room service, cocktails, or personally ordered wines, even if consumed in place of provisions provided during the Tour, gratuities to Tour Guide(s)/Leader(s)s and professional driver(s) of Guest’s specified Tour, any other costs not specified in the finalized Tour itinerary or elsewhere in writing. Guest is responsible for all of the above and the cost of any changes he or she makes outside the Tour and Tour provisions. Guest is responsible for his/her transportation costs incurred to and from the Tour hotel in the event that Guest is unable to participate in the group pick-up on Tour start day and/or group drop-off on Tour conclusion day.

GUIDES/TRANSPORTATION: Guide services on all Tours are English speaking. Air-conditioned vehicles are utilized. Bottled still water is included on all excursions.

ACCOMMODATIONS: Guest accommodations during a Tour are double, twin or single occupancy, and will include private, fully equipped, en-suite bathrooms. Hotels are selected for their charm, history and location relative to daily Tour activities. Hotel rooms are well appointed, individual, private rooms with large comfortable queen, two twin, queen or king size beds and fully equipped, private, en-suite bathrooms (tub/shower, sink, toilet, etc.) that Operator has determined to meet its strict criteria. Room size on Tours is traditional European standard. Because selected hotels are smaller, boutique hotels, no two rooms are alike. Rooms all vary in size or decoration. Rooms are decorated in tasteful, high end furnishings and antiques that reflect the heart and soul of each region. In France, a twin room to be shared by two persons is comprised of two single (twin) size beds plus a fully-equipped, private, en-suite bathroom. A double room is comprised of either 1 queen or 1 king size bed, plus a fully equipped private, en-suite bathroom. Beds in France are smaller than traditional North American beds. French hotel beds do not include mattress toppers nor are the mattresses memory form. Hotel designation is subject to change without notice at Operator’s discretion and based on availability at time Tour is sold to its capacity.

WAIVER OF LIABILITY: Operator expressly limits its’ performance to the delivery of a Tour with accompanying food, lodging and ground transportation from site to site. Operator and its’ agents expressly exclude all other guarantees and warranties including but not limited to, the warranty of workmanlike performance of Operator and its’ agents. Furthermore, Operator and its’ agents will not be responsible for any direct or indirect consequential damages or injury that may result from a Tour. The Guest is completely responsible for all actions, and agrees to hold harmless Operator and its’ agents for any accident, damages or injury. Operator and its’ agents are not responsible for Acts of God or acts of war/terrorism, and Guest agrees to hold Operator and its’ agents harmless for any incident or injury resulting from the same, or as a result of any force majeure. Only Operator may finalize an order or Tour booking and make it a binding contract to provide the services of Operator to Guest. Responsibilities of Guest include, but are not limited to the adherence of all local laws, respecting customs, culture, guides and local professionals, assessing abilities, respecting other Guests’ privacy, and following the suggestions and advice of the Operator and Tour guide during a Tour. Operator reserves the right to decline, accept, or retain at any time, any Guest, as a participant of a Tour, if Operator deems that Guest behavior is disruptive to the group or Tour, is inappropriate and offensive to the Group or interferes with the delivery of services of the Tour. Operator reserves the right to remove any Guest from a Tour should Operator determine that the Guest cannot meet the physical requirements of the Tour, as stated in the Tour itinerary, or is disruptive to the Tour time schedule, or is adversely affecting the overall group dynamics. In the event that a Guest is removed from a Tour, Operator will not refund any monies to the Guest. Transportation costs to return home, airline penalties, and any other expenses will be the responsibility of the Guest. In the event that a Guest voluntarily chooses to leave a Tour, Operator will require a written, signed statement of the Guest’s intent to depart from the Tour. In the event that a Guest voluntarily departs from a Tour, Operator will not refund any monies to the Guest. Transportation costs to return home, airline penalties, and any other expenses will be the responsibility of the Guest. During a Tour, Guest participates in as many or as few activities of interest to Guest and at Guest’s discretion. No refunds for unused services, activities, excursions, workshops or portions of a Tour for any reason will be made to Guest.

HEALTH: By completing either an online booking form or a print/fax booking form and by sending a deposit toward your trip purchase, Guest certifies that he/she does not have any physical condition or disability that would create a hazard for him/her or other travelers, certifies that he/she is physically able to participate in the Tour and certifies that he/she is aware of all Tour walking and standing disclosures and requirements of the Tour.

INSURANCE: Trip cancellation/interruption insurance is recommended, but not required to participate in a Tour. No exceptions can be made to Operator Terms and Conditions policies. Trip cancellation/interruption insurance will protect Guest should he or she need to cancel for certain necessary reasons such as illness, unemployment, death, and provides Guest refunds for air and Tour. Additional insurance for baggage, health/accident is also available through most major travel insurance providers. Operator is not responsible for additional expenses that may occur, as a result of Guest not purchasing travel insurance.

USE OF GUEST IMAGES/FEEDBACK in Operator’s Promotional Materials: Photographs and video taken by Operator’s Tour leaders and other Operator representatives during a Tour are the property of Operator, and may be used in promotional materials. Feedback, both verbal and/or written, provided by Guest to Operator about a Tour is also the property of Operator, and may be used in promotional materials, including Operator’s website.

ACCEPTANCE OF TERMS AND CONDITIONS: Acceptance of the initial services to be provided on the Tour shall constitute an acceptance by the Guest of these Terms and Conditions recited above. Guest understands that this is a legally binding and enforceable contract. By paying the Tour deposit to Operator, the depositor, also known and referred to herein as Guest, therefore agrees to be bound by the above-recited Operator Terms and Conditions.

Our “100% RISK FREE BOOKING & TRAVEL” promotional cancellation policy – Your tour deposit and balance payment are 100% refundable until 31 days before tour departure, and at 30 days or less, funds are 100% transferable to a future tour. There are NO limitations or restrictions!
