It is each individual traveler's responsibility to read and understand the terms and conditions of Off the Beaten Path, LLC prior to submitting a tour reservation.

PARTIES: Off the Beaten Path, LLC, hereinafter referred to as "Operator", provides tours in the country of France (each a "Tour"). These Terms and Conditions apply to each Tour program provided by "Operator", hereinafter referred to as "Tour". In these Terms and Conditions, the undersigned is hereinafter referred to as "Guest".

RESERVATIONS are accepted by Operator upon receipt of a completed and signed, printed reservation form, or upon receipt of a completed and electronically signed, online reservation form accompanied by a non-refundable deposit of US$500 per Guest per Tour. The remaining balance of the Tour is due no later than 90 days prior to the Tour departure date, and invoices for final payment of Tour will be emailed to each Guest prior to the Tour final payment due date. Reservations made within 90 days of Tour departure date must be accompanied by full payment. If Operator does not receive final payment of Tour from Guest by 90 days prior to Tour departure date, Operator reserves the right to cancel Guest's reservation at which time Guest forfeits the non-refundable deposit. Operator reserves the right to assess a US$350 per person late fee for final payments received after the final payment due date. Specialty event tours, private tours and custom designed tours require a non-refundable deposit of US$1000 per person, and final tour payment for specialty event tours, private tours and custom designed tours is due no later than 120 days prior to the tour departure date, and is payable by wire transfer, personal check or cashier check only.

CLIENT CANCELLATION & REFUND POLICY: If Guest chooses to cancel his or her reservation, Operator must receive written notice of said cancellation in writing via certified mail, fax or e-mail sent to reservations@traveloffthebeatenpath.com (with confirmation of receipt from Operator), and Guest shall be subject to the following cancellation fee schedule: If Operator receives written notice 91 or more days prior to the Tour start date, Operator shall with-hold the non-refundable deposit. If Operator receives written notice 31-90 days prior to the Tour start date, Operator shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 50% of the remaining balance due for the Tour. If Operator receives written notice 30 days or less prior to the Tour start date, Operator shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 100% of the remaining balance due for the Tour. If Operator receives no written cancellation from Guest and Guest does not show-up for the Tour per Guest reservation, Guest shall incur a cancellation/no-show fee equal to 100% of the Tour price. Cancellation date is the date such notice is received in writing by Operator and acknowledged as received by Operator. Specialty event Tours, Private Tours and custom designed Tours cancellation fees are as follows: If Operator receives written notice 121 or more days prior to the Tour start date, Operator shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 25% of the remaining balance due for the Tour. If Operator receives written notice 61-120 days prior to the Tour start date, Operator shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 50% of the remaining balance due for the Tour. If Operator receives written notice 60 days or less prior to the Tour start date, Operator shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 100% of the remaining balance due for the Tour.

Should Guest cancel his/her reservation 91 days or more in advance of the departure date, Guest may elect to roll the entire $500 per person non-refundable deposit into a future trip credit to be used towards an Off the Beaten Path trip departing within 12 months of the original trip cancellation date. This credit can only be rolled over once.

OPERATOR CANCELLATION OR SUBSTITUTION: Operator may cancel any Tour at any time before departure for any reason, including without limitation, if Operator deems the number of Guests signed up for a given Tour to be insufficient to operate such Tour. Operator may in its' sole discretion substitute a Service or Good of similar quality for any Service or Good stated in a Tour itinerary. Operator shall attempt to notify Guest of the cancellation of a Tour for which Guest has paid a deposit or Tour Fee as soon as possible after Operator's final decision to cancel such Tour. If a Tour is cancelled, Operator's liability is limited to a full refund of affected Guest's Tour deposits and Tour Fees, and Operator will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever in such circumstances. Operator is not responsible for any loss incurred on account of non-refundable or non-transferable air tickets. If for reasons beyond Operator's control, a Tour in progress must be interrupted or cancelled, Operator will in good faith refund a portion of the Tour Fees depending on Operator's actual costs incurred compared to the Tour as originally contemplated.

INCLUDED: in the price of the Tour are the following: Professional Off the Beaten Path, LLC historian guide/Tour leader(s) who also serves as Guests' liaison during the Tour, hotel accommodations as designated by Operator during the Tour, entry fees to historic sites and monuments detailed in the finalized tour itinerary, fees for interactive excursions during the Tour as detailed in the finalized itinerary, such as, cooking classes, wine tasting workshops, bread baking class, some beverages during meals provided on the Tour as detailed in the finalized tour itinerary, hotel taxes, breakfast daily, gratuities to service personnel at restaurants designated in the finalized itinerary and at the hotel, meals as specified in the finalized itinerary, private ground transportation during the tour from Tour start date pick-up and Tour conclusion drop-off.

NOT INCLUDED: in the cost of the Tour are the following: Roundtrip airfare/trainfare to and from France and Tour start and conclusion city/group meeting location, telephone calls, personal items, laundry, individual purchases, pre-dinner alcoholic beverages, wines beyond provisions of the tour, extra meals or snacks, room service, cocktails, or personally ordered wines, even if consumed in place of provisions provided during the Tour, gratuities to Tour Guide(s)/Leader(s)s of Guest's specified Tour, any other costs not specified in the finalized Tour itinerary or elsewhere in writing. Guest is responsible for all of the above and the cost of any changes he or she makes outside the Tour and Tour provisions. Guest is responsible for transportation costs to and from the Tour hotel in the event that Guest is unable to participate in the group pick-up on tour start day and/or group drop-off on tour conclusion day.

PRICES: Due to fluctuations in the US Dollar/Euro currency exchange rates, Operator ONLY guarantees a Tour price as indicated on Operator's website upon Operator's receipt of Guest's completed online or faxed reservation/Tour booking form. Otherwise, prices are subject to change without notice. Once Operator receives Guest's completed Tour booking form, Guest's Tour price is guaranteed and the Tour price will NOT increase.

ACCOMMODATIONS: Guest accommodations during a Tour are double or twin occupancy, and will include private, fully equipped, en-suite bathrooms. Hotels are selected for their charm, history and luxury. Hotel rooms are well appointed, individual, private rooms with large comfortable queen or king size beds and fully equipped, private, en-suite bathrooms (tub/shower, sink, toilet, etc.) that Operator has determined to meet its' strict criteria. Rooms on Tours are larger than traditional European standards. In France, a Twin room to be shared by two persons is comprised of two single(twin) size beds plus a fully-equipped, private, en-suite bathroom. A double room is comprised of either 1 queen or 1 king size bed, plus a fully equipped private, en-suite bathroom.

RESPONSIBILITY: Operator expressly limits its' performance to the delivery of a Tour with accompanying food, lodging and ground transportation from site to site. Operator and its' agents expressly exclude all other guarantees and warranties including but not limited to, the warranty of workmanlike performance of Operator and its' agents. Furthermore, Operator and its' agents will not be responsible for any direct or indirect consequential damages or injury that may result from a Tour. The Guest is completely responsible for all actions, and agrees to hold harmless Operator and its' agents for any accident, damages or injury. Operator and its' agents are not responsible for Acts of God or acts of war/terrorism, and Guest agrees to hold Operator and its' agents harmless for any incident or injury resulting from the same, or as a result of any force majeure. Only Operator may finalize an order or Tour booking and make it a binding contract to provide the services of Operator to Guest. Responsibilities of Guest include, but are not limited to the adherence of all local laws, respecting customs and culture, assessing abilities, respecting other Guests' privacy, and following the suggestions and advice of the Operator and Tour guide during a Tour. Operator reserves the right to decline, accept, or retain at any time, any Guest, as a participant of a Tour, if Operator deems that Guest behavior is disruptive to the group or Tour, is inappropriate and offensive to the Group or interferes with the delivery of services of the Tour. Operator reserves the right to remove any Guest from a Tour should Operator determine that the Guest cannot meet the physical requirements of the Tour, as stated in the Tour itinerary, or is disruptive to the Tour time schedule, or is adversely affecting the overall group dynamics. In the event that a Guest is removed from a Tour, Operator will not refund any monies to the Guest. Transportation costs to return home, airline penalties, and any other expenses will be the responsibility of the Guest. In the event that a Guest voluntarily chooses to leave a Tour, Operator will require a written, signed statement of the Guest's intent to depart from the Tour. In the event that a Guest voluntarily departs from a Tour, Operator will not refund any monies to the Guest. Transportation costs to return home, airline penalties, and any other expenses will be the responsibility of the Guest. During a Tour, Guest participates in as many or as few activities of interest to him or her. No refunds for unused services, activities, excursions, workshops or portions of a Tour for any reason will be made to Guest.

ELIGIBILITY Operator requires that Guests be at least 18 years of age (at time of travel) on all trips, with the exception of ÒCustom Designed or Private TripsÓ where Guest is paying a supplement for Operator to provide private or custom designed tour services for Guests' private travel group.

HEALTH By completing either an online booking form or a print/fax booking form and by sending a deposit toward your trip purchase, Guest certifies that he/she does not have any physical condition or disability that would create a hazard for him/her or other travellers.

INSURANCE: Trip cancellation/interruption insurance is recommended, but not required to participate in a Tour. Trip cancellation/interruption insurance will protect Guest should he or she need to cancel for certain necessary reasons such as illness, unemployment, death, and provides Guest refunds for air and Tour in full. Additional insurance for baggage, health/accident is also strongly recommended and available through most major travel insurance providers.

USE OF GUEST IMAGES/FEEDBACK in Operator's Promotional Materials: Photographs and video taken by Operator's Tour leaders and other Operator representatives during a Tour are the property of Operator, and may be used in promotional materials. Feedback, both verbal and/or written, provided by Guest to Operator about a Tour is also the property of Operator, and may be used in promotional materials, including Operator's website. Any Guest who does not wish to have his or her photograph, video footage or feedback used in promotional material must advise Operator in writing no later than the tour start date.
